Parte-se do princípio no qual as Universidades Federais brasileiras geralmente exercem seus regimes disciplinares sem conhecer a real dimensão dos custos gerados. Diante de desse fato, objetiva-se estimar o custo unitário de Processos Administrativos Disciplinares (PADs) para a Fundação Universidade Federal de Rondônia (UNIR). A pesquisa caracterizou-se pela natureza descritiva, abordagem qualitativa/quantitativa, com fontes bibliográfica e documental a partir de uma amostra aleatória de 79 PADs de um universo de 124 PADs instaurados entre 2013 a 2016. Os resultados mostraram que quatro servidores compuseram o núcleo ativo dessas comissões; o tempo médio utilizado foi de 133 dias, e de 120 dias pela autoridade julgadora, sendo que a estimativa de custo unitário por processo foi de R$ 51.201,07. Conclui-se que ambos os tempos médios gastos são superiores aos prazos legais da Lei nº 8.112/90; e que o custo unitário é um pouco superior ao informado na literatura. Em suma, tanto os atrasos processuais ocorridos no âmbito das comissões quanto no poder da autoridade julgadora; assim como o custo unitário, seguem o padrão nacional.
Abstract
It starts from the principle that Brazilian Federal Universities generally exercise their disciplinary regimes without knowing the real dimension of the costs generated. Given this fact, the objective is to estimate the unit cost of Disciplinary Administrative Proceedings (PADs) for the Fundação Universidade Federal de Rondônia (UNIR). The research was characterized by its descriptive nature, qualitative/quantitative approach, with bibliographic and documentary sources from a random sample of 79 PADs from a universe of 124 PADs installed between 2013 and 2016. The results showed that four servers made up the active core of these commissions; the average time used was 133 days, and 120 days by the judging authority, and the estimated unit cost per process was R$ 51,201.07. It is concluded that both the average times spent are superior to the legal deadlines of Law nº 8.112/90; and that the unit cost is a little higher than that reported in the literature. In short, both the procedural delays that occurred within the scope of the commissions and in the power of the judging authority; as well as the unit cost, follow the national standard.
